Coaching Terms and Conditions

By joining the Premium or Standard Coaching referred to from here as Personalised Coaching you agree to the following terms and conditions.

Coaching is partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximise personal potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.

  1. Coaching Relationship
    a) Coach agrees to maintain the ethics and standards of behavior established by the International Coach Federation “(ICF)” (Coachfederation.org/ethics).
    b) Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
    c) Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.
    d) If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.
    e) The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.

  2. Coaching Fees
    a) For a Personalised Coaching Membership, you must make your payment monthly or quarterly.
    b) Client agrees to work with coach for a minimum of 12 weeks.
    b) If there are repeated failures to meet payment obligations (other than through the fault of Eat Run Lift or its Payment Provider), Client’s membership may be suspended or terminated by Written Notice to Client and debt will be sold to a debt collection agency.

  3. Termination of Membership
    If The Client is looking to terminate membership:
    a) You have a statutory right to change your mind (without giving a reason) within 3 days of purchasing the Personalised Coaching and receive a refund. This will not apply if you have already started downloading the relevant product.
    b) You can cancel due to illness or medical reasons without being charged a fee. You will be required to provide relevant documentation.
    c) Cancelling an Ongoing Agreement After the Minimum Term (12 weeks): You may cancel by providing a 4-week written notice to Eat Run Lift or Rachel Aust (via email to hello@eatrunlift.me).

  4. Registration
    a) When you register as a member for Personalised Coaching we will ask that you provide certain personal information including but not limited to your name, email address, postal address, and, your payment details. Any personal information you provide to us with will be handled in accordance with our Privacy and Data Protection Policy.
    b) On registration you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us by contacting hello@eatrunlift.me immediately.
    c) If we have reason to believe that there is likely to be a breach of security or misuse of the Website through your account by means of the use of your password or otherwise we may require you to change your password or we may suspend your account. Until we are satisfied that your account is secure, you may not be able to access the Website.
    d) You agree that all personal information that you supply to us will be accurate, complete and kept up to date at all times. We may use the information provided to us to contact you.

  5. Availability
    a) Although we aim to offer you the best service possible, we make no promise that the Website or mobile app will meet your requirements. We cannot guarantee that the Website or mobile app will be fault-free. If a fault occurs with the Website or mobile app you should report it to hello@eatrunlift.me and we will attempt to correct the fault as soon as we reasonably can.
    b) Your access to the Website or mobile app may be occasionally restricted or interrupted to allow for repairs, maintenance or the introduction of new facilities or services or because we are unable to offer the Website for reasons beyond our control (such as a denial of service attack). In this event we will attempt to restore the service as soon as we reasonably can. Any such restrictions or interruptions shall not constitute a breach by us of these terms.

  6. Our Liability
    a) Nothing in the agreement excludes our liability arising as a result of our negligence for:
    Death or personal injury;
    Fraud or fraudulent misrepresentation.
    b) Eat Run Lift (nor any of its employees, agents or representatives), is not engaged in rendering medical advice, nor does it (or any of its employees, agents or representatives) hold itself as qualified to do so.
    c) We strongly recommend that you seek professional medical advice before embarking on any diet or exercise program. Any exercise program, even in healthy individuals, carries risk. You have a responsibility to exercise you own personal judgment, as well as any other considerations, before acting on any of the content provided by us.
    d) Where we provide you with a Personal Plan, the information contained therein should not be regarded as or relied upon as being a fully comprehensive health or exercise programme. Accordingly any actions that you take in relation to a personal plan should not be pursued regardless or to the exclusion of other information, opinions or judgments that are available to you.
    e) Any Personal Plan will have been prepared on the basis of information provided by you. You are responsible for the accuracy of any information that you provide to us. You are responsible for informing us of any health issues or medical conditions when asking us to prepare a Personal Plan.
    f) Before taking any action in relation to a Personal Plan, you must take into account any other factors apart from the Personal Plan of which you are or ought to be aware. For example, we always recommend that you seek professional medical advice before embarking on any exercise program. Your decisions to engage in any exercise program should take into account any medical or other professional advice that it available to you as well as using your own personal judgment as to what activity is safe for you to engage in.
    g) The information set out in any Personal Plan may relate to certain contexts and may not be suitable in other contexts. It is your responsibility to ensure that you do not use the information we provide in the wrong context.
    For example, where a program was tailored for a woman who was not pregnant, this would not be appropriate for her to use after becoming pregnant. You are responsible for informing us of any health issues and pre-existing medical conditions when you ask us to prepare a Personal Plan.

  7. Expected Results
    a) While we believe that for most people, following our programs and methods will lead to desired results, all exercise programmes depend on the individual. Result will be affected by the effort and commitment of the individual, however in some circumstances even where an individual follows our program, they may not achieve the desired results. We therefore provide no warranties of any kind, express or implied, as to:
    the effectiveness any techniques, diets or programs that we deliver; or
    the results that you may achieve as a result of following our programs.
    b) All testimonials contain shown on our website or in our content are real people who have followed the plans provided by Eat Run Lift. For the avoidance of any doubt, however, they are not indicative of the results that you are likely to achieve, rather they are included as examples of the results that particular individuals have achieved.

  8. Intellectual Property
    a) By providing any content for distribution by the us (such as before and after photographs, written testimonials, or messages exchanged with Rachel Aust or Mariana Amaral within the Eat Run Lift training app) you expressly grant us a worldwide, royalty-free, perpetual, irrevocable licence to use, copy, store, perform, display and distribute such content.
    b) The format and content of the Website is protected by Australian and International copyright and we reserve all rights in relation to our copyright whether owned or licensed to us and all rights are reserved to any of our registered and unregistered trademarks (whether owned or licensed to us) which appear on the Website.
    c) This Website or any portion of this Website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not systematically extract and/or re-utilise parts of the contents of the Website without our express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of the Website without our express written consent.

  9. General
    a) These conditions are governed by and construed in accordance with the laws of Victoria, Australia. You agree, as we do, to submit to the non-exclusive jurisdiction of the Australian courts.
    b) If you breach these Terms of Use and we decide to take no action or neglect to do so, then we will still be entitled to take action and enforce our rights and remedies for any other breach.
    c) We will not be responsible for any breach of these Terms of Use caused by circumstances beyond our reasonable control.
    d) We may make changes to the format of the Website at any time without notice.
    e) We require that our clients be over the age of 18 or have express written permission of their parents before we can begin a coaching arrangement. Please do not purchase our products if you are under 18 without first getting written permission from your parent or guardian.
    f) In case you are not redirected back to our website after purchase or you do not receive an email from us with a link to the product of your purchase, you can immediately contact us at hello@eatrunlift.me with your transaction details, including the email ID through which the payment was made. We will revert back to you with your product details and download link as soon as possible.
    g) Eat Run Lift reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice.

  10. Eat Run Lift offers three levels of coaching: Standard Coaching, Premium Coaching, and VIP 1:1 Program. Each level includes distinct features and support as outlined below:

    All Coaching Levels

    Full Nutritional Support
    You will receive a meal plan, meal idea sheet, and/or tailored calorie/macronutrient targets every 4 weeks, based on your current goals and nutrition IQ.
    Full ongoing nutritional support includes guidance on tracking calories, a library of meal ideas, and tips on structuring meals throughout the day.
    Live webinar recordings and video lessons are provided to help you understand the 'why' behind all your food choices.

    Custom Training & Cardio
    Training is tailored to your goals and lifestyle, including specific exercises, reps, and sets with a weight logging feature to track every exercise.
    Each exercise comes with a video demonstration to ensure proper execution.

    Exercise Form Checks
    Exercise form checks are available via video on our app to ensure exercises and movements are performed correctly.

    Mindfulness & Meditation Calls
    Participate in live mindfulness and meditation sessions with Coach Hannah to learn how to de-stress, build balance, and unlock creativity.

    Regular Program Changes
    A new training cycle is provided every 12-14 weeks, based on your feedback, results, and thoughts from the previous program. A 12-week review allows for assessment of program effectiveness and necessary changes.

    Daily Communication
    Communicate 5 days a week via the messenger feature of the app, with all questions and queries answered quickly and efficiently.

    Group Coaching Calls & Live Trainings
    Unlimited group support calls and live training webinars with Rachel.
    Access to mindfulness and meditation calls with Coach Hannah and topic deep dives to help you level up your lifestyle and mindset.

    Premium Coaching

    Includes all features in All Coaching Levels, plus:

    Mindset Coaching Program
    A 24-week program offering clarity, insight, and actionable steps to take control of your health and find peace, love, and a deeper connection with yourself.
    Learn to overcome emotional eating, address self-sabotage, and become your most confident self.

    Weekly Check-Ins
    Weekly check-ins with voice note responses from the coach, including any necessary adjustments to your program.

    VIP 1:1 Program

    Includes all features in Premium Coaching, plus:

    Private Video Calls with Rachel
    Two 30-minute private video calls each month with Rachel for personalized guidance and support.
